Submission is only open to individuals who are, as of the date of entry, (a) legal residents of Canada, (b) at least eighteen (18) years old, and (c) the parent(s) or legal guardian(s) of a dog as of the date of entry (an “Eligible Dog”).

The Entry Period is ongoing until further notice

To enter for a chance to be chosen, you must submit: (a) a picture of your Eligible Dog with a product of Foley Dog Treat Company (your “Entry”). Make sure you comply with the entry requirements set forth below. Foley Dog Treat Company reserves the right to disqualify any Entry that does not meet these requirements, in its sole discretion.

Your Entry must meet the following requirements:

1. You (or an immediate family member) must take the photo of your Eligible Dog during the Entry Period. 
2. Your Entry must include – one (1) Eligible Dog 
3. You may not use any filters and you cannot edit or retouch your Entry. The use of A.I. (Artificial Intelligence) in your Entry in any way is not allowed.
4. You must answer all questions on the entry form.
5. The Entry may not prominently feature any third-party trademarks, logos, or artwork. Moreover, it may not violate anyone’s rights, including, but not limited to, copyrights or trademark rights. You must have all rights and permissions to submit and share your Entry.
6. The Entry may not portray Foley Dog Treat Company or its products in a negative light or contain any content that is inappropriate or indecent, as determined by Foley Dog Treat Company, in its sole discretion.
7. Entries must be sent from unique email addresses. If submitting more than one Eligible Dog, please use a unique email address for each Entry.

Visit www.foleydogtreat.com/pages/next-vitalitydog during the Entry Period, fill out the entry form, and submit your Entry. There is a limit of one (1) entry per Eligible Dog. (If you have more than one (1) Eligible Dog, you can submit a separate Entry for each one.) Foley Dog Treat Company reserves the right to disqualify any individual that attempts to enter more times or otherwise violates these Official Rules.

By entering, you represent and warrant that your Entry complies with all requirements in these Official Rules and that you have all the rights necessary to grant Foley Dog Treat Company the rights to your Entry described in Section 6. Further, by entering you indicate your agreement to these Official Rules and Foley Dog Treat Company’s decisions regarding the Submission, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Official Rules.

You do not transfer ownership of your Entry by entering the Submission. However, by entering, you grant Foley Dog Treat Company and any assigns, an irrevocable, perpetual (non-exclusive) right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you.

During and after the Entry Period, a diverse panel of judges selected by Foley Dog Treat Company will evaluate eligible Entries based on the following criteria: (a) expressiveness of Dog in Entry (b) Dog with Foley Dog Treat Company product (c) answers to the questions that you have submitted. The entrants with the highest scores will be deemed potential winners and be contacted by e-mail. Foley Dog Treat Company will never reach out from an unverified social handle or ask you for your credit card information or other payment details. The odds of winning depend on the performance of each entrant.

Winner must be able to take & provide photos as requested by Foley Dog Treat Company.  Photos will remain property of Foley Dog Treat Company. Foley Dog Treat Company reserves the right to disqualify a potential winner if he/she does not comply with the requirements above. If a potential winner is disqualified, Foley Dog Treat Company may select an alternate potential winner in his/her place according to the Judging Criteria.

Grand Prize: The winning dog(s) will receive:

Any prize details not specified above will be determined by Foley Dog Treat Company, in its sole discretion. A prize may not be transferred and must be accepted as awarded. Foley Dog Treat Company reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Foley Dog Treat Company, in its sole discretion.

Foley Dog Treat Company reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Submission, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Foley Dog Treat Company’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Foley Dog Treat Company by mail shall not be deemed proof of receipt of that communication by Foley Dog Treat Company. The Submission is subject to federal and local laws and regulations and is void where prohibited.

By entering, you agree to release and hold harmless the Submission Entities, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Submission or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Submission; (b) technical errors related that may impede entry; (c) any claim or allegation that your Entry infringes any copyright, trademark, or any other intellectual property right; (d) lost, late, misdirected, or undeliverable mail; (e) errors in the administration of the Submission or the processing of entries; or (f) injury or damage to persons, pets, or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Any information you submit as part of the Submission will be treated in accordance with Foley Dog Treat Company’s Privacy Policy. Except where prohibited, participation in the Submission constitutes your consent to Foley Dog Treat Company’s use of your name and Entry for promotional purposes in any media without further payment or consideration.

Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Submission or any prize shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in British Columbia. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or Foley Dog Treat Company’s rights and obligations in connection with the Submission, shall be governed by, and construed in accordance with, the laws of British Columbia, without giving effect to any choice of law or conflict of law rules (whether of British Columbia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than British Columbia.
